Wine in Retail Certificate of Compliance Application
A retail food store wine license allows businesses such as grocery stores and convenience stores to sell wine for off-premises consumption. “Retail food store” means an establishment that is open to the public that derives at least twenty percent (20%) of its sales taxable sales from the retail sale of food and food ingredients for human consumption taxed at the rate provided in T.C.A. § 67-6-228(a) and has retail floor space of at least one thousand two hundred square feet (1,200 sq. ft.). The Retail Food Store Wine License application process is regulated through the Tennessee Alcoholic Beverage Commission. At the local level, the Town of Smyrna will assist with the following, which is required as part of the State's application process:
- Certificate of Compliance (COC) — A retail food store license cannot be issued unless the business obtains a COC from the local government. The COC must confirm that the establishment meets all local zoning laws and that the owners or persons in charge do not have any felony convictions. A COC doesn’t need to be renewed and remains valid unless there is a change in ownership or location of the store. A COC approved by a city must be signed by either the mayor or a majority of the city’s legislative body members.
